Our Texas-based law firm is seeking a talented and experienced Premises/Product Liability Attorney to join our litigation team. The ideal candidate will have a strong background in defending or prosecuting premises liability and product liability cases. You will work on complex cases, including those involving personal injury, defective products, unsafe premises, and other liability matters. Key Responsibilities:
- Case Management: Handle all aspects of premises and product liability cases, from investigation through settlement or trial. Manage cases, including client interaction, gathering evidence, conducting discovery, and preparing for trial.
- Legal Research & Strategy: Conduct in-depth legal research on case law, statutes, and regulations related to premises liability and product liability. Develop case strategies based on your research and applicable law.
- Litigation & Court Appearances: Represent clients in court, including attending hearings, depositions, motions, and trials. Handle all aspects of litigation, including filing motions, preparing witnesses, and developing trial strategies.
- Client Communication: Maintain regular communication with clients, providing them with updates and legal guidance on case developments. Ensure clients are informed and confident throughout the litigation process.
- Settlement Negotiations: Negotiate favorable settlements on behalf of clients, utilizing your litigation experience to secure optimal outcomes.
- Discovery & Investigation: Oversee the discovery process, including drafting and responding to discovery requests, conducting depositions, and working with experts to evaluate liability and damages.
- Document Preparation: Draft and file legal documents, including complaints, motions, responses, and settlement agreements. Ensure compliance with relevant court rules, procedures, and deadlines.
- Team Collaboration: Work collaboratively with colleagues, paralegals, and support staff to provide the highest level of legal service and ensure that all case tasks are handled efficiently and effectively.
- Expert & Witness Management: Coordinate with expert witnesses, including gathering and reviewing expert reports, preparing experts for testimony, and developing strategies for their use at trial.
- Industry Knowledge & Client Education: Stay updated on industry trends, regulatory changes, and new legal developments in product and premises liability. Educate clients on potential legal risks and advise on preventative measures when appropriate.
Qualifications:
- Juris Doctor (JD) degree from an accredited law school.
- Active license to practice law in Texas.
- 3+ years of experience in premises liability, product liability, or personal injury litigation.
- Proven trial experience, with a successful track record in representing clients in court.
- Strong knowledge of state and federal laws regarding premises and product liability, including the Texas Tort Claims Act and other relevant statutes and case law.
- Excellent written and verbal communication skills, with the ability to communicate complex legal concepts to clients, opposing counsel, and juries.
- Experience in managing complex cases, including drafting pleadings, conducting discovery, and taking depositions.
- Strong negotiation skills, with the ability to secure favorable outcomes for clients.
- Ability to manage multiple cases simultaneously, with exceptional organizational skills and attention to detail.
- Strong client service skills and the ability to work effectively with clients, experts, and other legal professionals.
- Ability to work independently as well as in a team-oriented environment.
Preferred Skills:
- Experience with large-scale product recalls or cases involving corporate defendants.
- Background in handling cases involving complex injuries, including catastrophic personal injury or wrongful death claims.
- Experience with handling insurance coverage issues related to premises and product liability claims.
- Familiarity with case management software (e.g., Clio, Relativity) and legal research tools (e.g., Westlaw, LexisNexis).
- Fluent in Spanish is a plus.
