We are seeking a highly skilled and motivated Commercial Trucking Attorney to join our growing law firm in Houston, Texas. The ideal candidate will have expertise in commercial trucking law, including regulatory compliance, liability defense, and accident litigation. As a member of our legal team, you will provide comprehensive legal services to clients in the trucking and transportation industries, advocating for their interests in both transactional matters and litigation.
Key Responsibilities:
- Litigation and Defense: Represent trucking companies, drivers, and other industry clients in legal disputes, including personal injury, accidents, cargo damage claims, and insurance disputes.
- Regulatory Compliance: Advise clients on compliance with state and federal trucking regulations, including FMCSA (Federal Motor Carrier Safety Administration) rules, hours-of-service regulations, and safety standards.
- Contract Negotiation and Drafting: Draft, review, and negotiate contracts, including freight contracts, carrier agreements, and vendor contracts to ensure they align with the needs of the client while remaining legally sound.
- Risk Management: Work with clients to develop strategies that mitigate risks associated with transportation and logistics operations, including driver safety programs and compliance audits.
- Claims Management: Assist clients in managing claims related to trucking accidents, cargo damage, and other commercial transportation issues.
- Legal Research: Conduct legal research on transportation laws and regulations, staying up-to-date with changes in both state and federal laws impacting the trucking industry.
- Client Communication: Maintain strong, clear, and professional communication with clients, providing updates on case progress and offering legal counsel in a timely manner.
- Settlement and Trial Preparation: Prepare for and represent clients in arbitration, mediation, or trial, focusing on achieving favorable outcomes.
Qualifications:
- Juris Doctor (JD) degree from an accredited law school.
- Active license to practice law in the State of Texas.
- 5+ years of experience in commercial trucking law, personal injury law, or transportation law (experience in litigation is highly preferred).
- Strong understanding of the Federal Motor Carrier Safety Administration (FMCSA) regulations, state transportation laws, and other related industry regulations.
- Proven experience in defending commercial trucking companies and drivers in personal injury cases, accidents, and liability disputes.
- Excellent research, writing, and oral advocacy skills.
- Strong negotiation skills and the ability to manage complex legal matters.
- Ability to work independently as well as part of a collaborative team.
- Exceptional attention to detail and organizational skills.
- Strong client service orientation with excellent interpersonal skills.
Preferred Skills:
- Experience with truck insurance claims and policy interpretation.
- Experience handling commercial disputes and contract negotiations within the trucking industry.
- Prior experience in risk management or compliance consulting for transportation companies.
